DOL is the agency charged with deciding whether an EEOICPA claim will be paid or not.  For Part B radiation claims NIOSH will do a dose reconstruction and send DOL the results.  After reviewing the dose reconstruction DOL will issue a recommended decision and then later a final decision.  For Part B Chronic Beryllium disease and silicosis claims, as well as all Part E claims, DOL will issue the decisions without any information from NIOSH.  Recommended and Final Decisions are often complicated and it can be useful to look previously decided claims to understand the form of the decision.  

DOL provides links to "significant decisions and orders" on their website.  Unfortunately, most of the decisions listed are from the early years of EEOICPA, with only 17 added in 2010, 3 added in 2011 and none at all added in 2012 and 2013.

EECAP is providing the following decisions to help the public understand how EEOICPA claims are, and have been, decided.  These decisions have been submitted by claimants and advocates to EECAP for this purpose and are used with permission.  These decisions help claimants understand what materials DOL relies upon to make the decisions and the kinds of materials DOL will accept as evidence.
