FOIAFOIA Requests

What is a FOIA Request?

The Freedom of Information Act (FOIA) law allows any person the right to access records from federal agencies, although there are nine exemptions to what information can be provided.  The law was enacted in 1966 and strengthened in  1974 following the Watergate scandal.  In 1986 Congress amended the law again to address the fees charged for FOIA requests  and stated that part of the reason for establishing fee waivers was to prevent federal agencies from withholding information because it was embarrassing to the agency.

The OPEN Government Act of 2007 made some changes in FIOA.  It defined and clarified who is a member of the News Media.  It provided for recovery of attorney fees and litigation costs and set time limits for the agencies to work within.

The Obama administration has directed agencies to apply a presumption of openness in responding to FOIA requests and work in a spirit of cooperation with FOIA requesters.  In addition to this Attorney General Holder addressed this in his FOIA Guidelines

The US Office of Special Counsel has developed a FOIA Handbook.

How do I file a FOIA Request?

You need to file a FOIA request with the agency that owns the information you seek.  Click on the following to file:

  • DOE has an online link for making FOIA requests
  • NIOSH FOIA requests are filed through the Center for Disease Control and Prevention and may be submitted online as well
  • DOL FOIA requests may be filed by emailing foiarequest@dol.gov.

    FOIAonline allows you to submit FOIA requests to all participating agencies from this website, track the status of requests, search for requests submitted by others, and generate up-to-the-minute reports on FOIA processing. Agencies currently using FOIAonline are: Environmental Protection Agency, Department of Commerce (except the US Patent and Trademark Office), Office of General Counsel of the National Archives and Records Administration, Merit Systems Protection Board, Federal Labor Relations Authority, and the Department of the Treasury's Departmental Offices, Alcohol and Tobacco Tax and Trade Bureau, Bureau of Engraving and Printing, Bureau of the Fiscal Service, Financial Crimes Enforcement Network (FinCEN), and United States Mint.

    EECAP FOIAs

    EECAP has made many FOIA requests since 2005 and received much of the information you find on these pages through FOIAs from DOE, NIOSH, and DOL.  DOE and NIOSH provide FOIA information to EECAP without charge and on July 13, 2010 NIOSH issued a statement that they would waive fees for all requesters who act as advocates for nuclear workers. On September 27, 2011 DOL began requesting prohibitively high fees to EECAP for FOIA information.  September 11 coincidentally was the same day the Associated Press ran a national story which was very embarrassing to DEEOIC, based on an EECAP FOIA request.

    DOL is also requiring prohibitively high fees from ANWAG and Cold War Patriots, which prevents these non-profits from obtaining needed information.

    2013 FOIA Request 1: CDC/ATSDER Request for all Communications regarding Rocky Flats

    January 27, 2013--ANWAG requested communications and reports from NIOSH on Rocky Flats SEC petition.  

    2013 FOIA Request 2: DOL Request for combined year end statistics for EEOICPA for 2005-2010

  • February 5, 2013--EECAP requested EEOICPA combined claim statistics for years 2005-2005.
  • April 10, 2013--DOL's Branch of Outreach & Technical Assistance sent a letter acknowledging EECAP's March 22 letter which seems to confuse the February 5th FIOA request for EEOICA combined statistics with the earlier November 2012 FOIA request for states EEOICPA statistics and asking for another copy of the publication contract.
  • April 10, 2013--DOL sent a letter administratively closing the FOIA request This letter seems to confuse the February 5th FIOA request for EEOICA combined statistics with the earlier November 2012 FOIA request for states EEOICPA statistics This  letter did not acknowledge receiving or discuss the contents of either of the January 15th or March 22nd letters EECAP sent.  This letter was mailed in the same envelope as the letter above it.
  • April 23, 2013--DOL responded with the requested material in paper form.

  • April 9, 2013--EECAP requested copies of emails related to the IOM report.

    2012 FOIA Request 1: CDC/ATSDR Communications regarding Rock Flats SEC Petition

  • March 20, 2013--ANWAG has been told the FOIA request will not be completed for 6-12 months.

    2012 FOIA Request 2: DOL-DEEOIC Teleconference Notes

  •   March 8, 2012--EECAP requested copies of the Teleconference records that DEEOIC uses as part of the administration of claims along with the EEOICPA Procedure Manual, Final Bulletins, and Final Circulars.  Unlike the Procedure Manual, Bulletins and Circulars the Teleconference records are secret and not available to the public.  EECAP requested them to evaluate and share with the public.
  • April 5, 2012--DEEOIC responded with a cost of $160 for the Teleconference Notes and denied EECAP's request for a fee waiver.
  • May 1, 2012--EECAP filed an appeal of the fee waiver denial.
  • May 30, 2012--DOL Appeals Unit responded that they had received EECAP's appeal.
  • August 8, 2012--EECAP wrote the DOL Appeals Unit to request a status update.
  • The DOL Appeals Unit did not respond.
  • November 29, 2012--EECAP requested help from FOIA Ombudsman's Office to get a status update.

  •  March 13, 2012--EECAP requested full data for EEOICPA statistics.
  • March 14, 2012--DOL acknowledged receipt of request.

    2012 FOIA Request 6: DOL-DEEOIC Performance Review Standards

  • June 5, 2012--EECAP requested copies of Performance Review Standards from the four District Offices and the National Office.
  •  June 27, 2012--DOL responded with copies of 14 Performance Review Standards.  Eight of these were identified by District office.  The other six were unidentified.
  • July 9, 2012--EECAP responded to thank DOL for the documents and asked for the unidentified documents to be identified by District Office.
  • October 10, 2012--DOL provided the clarification.
  • 2012 FOIA Request 7: DOL-OWCP Resource Center Contract

  • July 17, 2012--EECAP requested a copy of contract number DOLU109E30904 on the running of the EEOICPA Resource Centers through September 17, 2017.
  • August 7, 2012--OWCP responded with a copy of the contract.
  • 2012 FOIA Request 8: DOL-DEEOIC Emails

  • August 20, 2012--DOL denied ANWAG's request for a fee waiver and offered to provide the information requested for $80.
  • 2012 FOIA Request 9: DOL-DEEOIC Teleconference Notes

  • November 14, 2012--DOL denied ANWAG's request for copies of Teleconference Notes under Exception 5, stating that they were "pre-decisional deliberative process privilege" despite evidence that they had been used to evaluate claims.
  • 2012 FOIA Request 10: DOL-OWCP Actuarial Tables

  •  November 15, 2012--EECAP requested a copy of the OWCP 2011 actuarial study.
  • November 20, 2012--OWCP responded that they had received the request and EECAP could expect a response within 20 days.
  • EECAP received the Actuarial study within the 20 day period.
  • 2012 FOIA Request 11: DOL-DEEOIC Year End State Statistics for 2007-2011

  • November 15, 2012--EECAP requested statistics for each state for December 31 of 2007- 2010 as a news reporter.
  • November 20, 2012--DOL responded that it had received the request.
  • January 8, 2013--DOL responded denying fee waiver request because EECAP did not send a copy of a contract for publication of the article to be written and quoted cost to provide information of $5,920 for information within its database.
  • January 15, 2013--EECAP sent DOL a copy of the contract.
  • March 22, 2013--EECAP sent DOL a letter requesting a status update on when to expect the materials requested.
  • March 26, 2013--DOL's FOIA Portal shows that this FOIA request was decided on February 8, 2013.  EECAP has not received a letter from DEEOIC on this decision.
  • April 10, 2013--DOL sent a letter administratively closing the FOIA request because they say EECAP did not respond to their January 8th letter.  This most current letter did not acknowledge receiving or discuss the contents of either of the January 15th or March 22nd letters EECAP sent.
  • April 11, 2013--A different DOL department sent a letter acknowledging EECAP's March 22 letter and stating DOL did not receive the January 15th letter EECAP sent.  This letter requested EECAP resend the January 15th letter and publication contract so they can consider processing EECAP's FOIA request.
  • April 13, 2013--EECAP re-sent the requested publication contract and January 15th letter.
  • May 29, 2013--EECAP sent letter to DOL requesting to know when the material would be provided.

    2012 FOIA Request 12: DOL-DEEOIC Teleconference notes from January-September 2012

  • November 19, 2012--EECAP requested teleconference notes from January 1-September 30, 2012.

    2011 FOIA Request 1: DOE Portsmouth Industrial Hygienist Reports

  • January 24, 2011--EECAP requested all Industrial Hygienist reports for the Portsmouth Gaseous Diffusion Plant by online form.
  • January 26, 2011--DOE responded that the request had been sent to the Oak Ridge Office.
  • DOE has not responded or provided the documents as of March 18, 2013.
  • March 9, 2013--DOE responded with a list of documents to choose from to narrow the search.
  •  

    2011 FOIA Request 2: NIOSH Emails

  •  Feb 17, 2011--EECAP requested copies of emails between NIOSH and other parties concerning Mound 1959-1980 SEC around the bioassay logbook issue from 2009-2011.
  • February 17, 2011--NIOSH responded that the request had been received.
  • July 21, 2011--NIOSH provided some emails but not ones requested.
  • August 8, 2011--EECAP requested emails a second time.
  • March 22, 2013--EECAP requested the emails again.
  • April 30, 2013--NIOSH sent emails 26 months after first requested.
  • May 29, 2013--DOE responded that they have 547 pages that they are reviewing and provided # HQ-2013-00171-C.
  •   

    2011 FOIA Request 3: DOE Incident & Accident Reports for Mound's SM-Building from 1961-1968

  • April 3, 2011--EECAP requested copies of accident/incident reports for SM-Building from 1961-1968.
  • September 21, 2011--DOE responds and sends the records requested.
  •   

    2011 FOIA Request 4: DOE Mound Laboratory Notebooks

  •  July 8, 2011--EECAP requested 88 Mound Laboratory Notebooks.
  • August 10, 2011--DOE responds that fee waiver is granted.
  • September 2, 2011--DOE responds that they have found the files but they need to be reviewed before they are released.
  • EECAP received two large boxes of Mound Laboratory Notebooks from DOE.
  • 2011 FOIA Request 5:  DOL-DEEOIC EEOICPA Statistics

  •  August 19, 2011--EECAP requested EEOICPA statistics.  The FOIA kindly office called to discuss the request and helped EECAP reduce the amount of information requested.  EECAP was told that the information requested after this adjustment would be quick and easy to get.  EECAP uses contemporary data to power its interactive maps and wished to use the statistics to evaluate the historic payment rates of EEOICPA.
  • September 13, 2011--DEEOIC responded with a letter that sounded like the information would be provided.
  • September 27, 2011--DEEOIC responded by requesting $680 for the statistics requested and did not address the request for a fee waiver.  September 27 is also the day the Freddy Krueger story broke in the national news.
  • EECAP asked that DEEOIC consider the fee waiver request.
  • November 3, 2011--DEEOIC responded to EECAP's clarification and again denied the fee waiver.
  • November 20, 2011--EECAP provided DEEOIC with additional information to justify the fee waiver.
  • January 4, 2012--DEEOIC responded and again denied the fee waiver.
  • March 13, 2012--EECAP filed a new FOIA statistics request.  So much time had passed since the original FOIA request that the original data requested would not be useful.  After discussing the matter with a DOL employee, EECAP decided to file a new FOIA request for statistics using different dates.
  • April 11, 2012--DOL responded with a price of $2,800 and again denied the fee waiver.
  • May 1, 2012--EECAP filed an appeal of the fee waiver denial.
  • May 30, 2012--DOL Appeals Unit responded that they had received EECAP's appeal.
  • August 8, 2012--EECAP wrote the DOL Appeals Unit to request a status update.

  • September 2011--EECAP requested Mound Work Group White Papers from NIOSH.
  • October 26, 2011--DOE responded and sent papers requested with privacy exemptions.
  • 2011 FOIA Request 7: DOL-OWCP National Academy of Sciences SEM Review

  • October, 2011 EECAP requested a copy of the contract between DOL and NAS for the review of the SEM.
  • OWCP responded and sent a copy of the contract.
  • 2011 FOIA Request 8:DOL-DEEOIC-EEOICPA District Medical Consultant, Industrial Hygienist and Toxicologist Reports

  • December 1, 2011--EECAP made FOIA request for copies of DMC, IH, and Toxicologist reports from December 1, 2010 to November 30, 2011 for the Cleveland District Office and requested a fee waiver for the information.  DEEOIC uses these reports as very important pieces of evidence in adjudicating claims.  EECAP requested this information to share with the public and to analyze for consistency and validity.
  • December 20, 2011--DEEOIC denied the fee waiver request and requested $4,560 to provide the reports.  DEEOIC also requested clarification of the time period which EECAP had stated as "All".
  • January 17, 2012--EECAP replied to DEEOIC, defined the term "All" and provided additional justification for the granting of a fee waiver, and requested metrics on the standards used to determine fee waivers.
  • April 3, 2012--DEEOIC replied that EECAP still did not meet the standard for granting of a fee waiver and quoted an alternative method of obtaining the information for $20,000.
  • April 5, 2012--EECAP replied to DEEOIC to try again to meet DEEOIC's standard for granting a fee waiver.
  • April 11, 2012--EECAP again requested the criteria DOL uses to determine a fee waiver.
  • DEEOIC did not respond.
  • May 1, 2012--EECAP filed an appeal of the fee waiver denial.
  • May 30, 2012--DOL Appeals Unit responded that they had received EECAP's appeal.
  • August 8, 2012--EECAP wrote the DOL Appeals Unit to request a status update.
  • The DOL Appeals Unit did not respond.

    2011 FOIA Request 10: DOL-DEEOIC Seattle District Medical Consultant Reports

  • November 20, 2011--Private individual requested Seattle District Office's DMC reports.
  • December 20, 2011--DOL shut down an advocate's FOIA request by charging the advocate $7,560 for all reports provided by Seattle District Office's District Medical Consultants from December 1, 2010 to November 30, 2011.

    2010 FOIA Requests

    2010 FOIA Request 1: DOE-Dayton Project First Contract

    2010 FOIA Request 2: DOL-DEEOIC Emails discussing ANWAG, Cold War Patriots, Grassroots Organization of Sick Workers, and/or private individual

  • March 15, 2010--Private individuals request copies of DEEOIC emails discussing themselves and non-profit organizations they are affiliated with.
  • 2010 FOIA Request 2: DOL-DEEOIC-Claims Examiner, Industrial Hygienist, Hearing Officer Training Materials

  • May 11, 2010--EECAP requested training material and handbooks for EEOICPA Hearing Officers, Claims Examiners, and Industrial Hygienists.
  • June 24, 2011--When after a year DOL hadn't responded to this FOIA request EECAP requested a DOL employee check on the status of the request.
  • August 22, 2011--DEEOIC responded and provided EECAP with the entire Claims Examiner (23 chapters) Training Manual at no charge.  The training manual referred to claimants and their doctors with names like Freddy Krueger and Hannibal Lechter.
  • September 27, 2011--the Freddy Kruger story hit the national papers, after EECAP reported it.  Following this DOL removed the offending names from the Training manual.

    2010 FOIA Request 3: DOE-Dayton Project/Mound Contracts

  • October, 2010--EECAP requested DOE contracts on the Dayton Project.
  • November 15, 2010--DOE acknowledged receipt of FOIA and granted fee waiver.

    2009 FOIA Requests

    2009 FOIA Request 1: DOL-DEEOIC Materials regarding the Ruttenber Database for Rocky Flats SEC, Rocky Flats neutron data, ANWAG emails

  • January 26, 2009--ANWAG requests all discussion on the Ruttenber Database from November 22, 2007 to present.
  • February 20, 2008--ANWAG requests copies of correspondence on scientific literature concerning neutron radiation and Rocky Flats.
  • March 12, 2009--ANWAG reminds DOL they had not responded to her FOIA request.
  • March 16, 2009--DOL responds to ANWAG that DOL is consolidating ANWAG's most current FOIA requests.  DOL also says that they consider ANWAG to be a commercial use requester and if a fee waiver is requested ANWAG needs to provide additional information.
  • March 27, 2009--ANWAG responded to DOL as requested on why ANWAG should not be considered a commercial use requester, why the FOIA requests should not be aggregated, and that DOL should consider a fee waiver.
  • May 5, 2009--DOL responded to ANWAG denying a fee waiver because ANWAG did not state how providing the information would contribute to the public understanding of government operations, quoting from a 1987 memo.  SOL went on to quote from a 1984 case (Crooker v. Dept. of Army) on how a fee waiver was unwarranted because "information of interest to a small segment of the scientific community" would not "benefit the public at large".  The aggregation was allowed because the records requested were similar and the FOIA requests were received within the same week.
  • May 19, 2009--ANWAG filed an appeal.
  • February 26, 2010--DOL's Officer of the Soliciter decided ANWAG's appeal in favor of DOL.
  • July 20, 2010--DEEOIC received the FOIA appeals decision.
  • August 6, 2010--DOL sent ANWAG a letter on her March 2, 2009 FIOA request which aggregated 4 FOIA requests together including: (1)communications on Ruttenber Database for Rocky Flats, (2)all correspondence regarding neutron radiation scientific literature at Rocky Flats,  (3)DOL's Branch of Outreach & Technical Assistance response to 1 & 2, and (4) all communications regarding ANWAG from 2004 to present.  DOL also requested to know if ANWAG wanted to proceed with the FOIA and that the request would be considered "unusual circumstances" and not be ready within 20 days.
  • January 25, 2011--DOL followed up with a letter to restate what had happened with the FOIA requests and to give ANWAG 14 days to clarify the FOIA request.

  • EECAP requested information on a 1961 Grass Fire.
  • May 27, 2009--DOE responded that they received the request.
  • June 15, 2009--DOE responded that they were unable to locate any records.

  • July 6, 2009--EECAP requested a copy of the EEOICPA District Medical Consultant's Handbook.
  • DOL provided the Handbook at no charge.
  • 2009 FOIA Request 3: DEEOIC-DOL Bonuses

  • April 29, 2009--EECAP requested a copy of DOL EEOICPA bonuses paid.
  • June 16, 2009--DOL provided information on where to find the information
